Pending Legal Action by Cal Poly, San Luis Obispo

Dear CalPolyOnline.com Members and visitors:

The forum will be temporarily closed sometime soon until further notice as there is a pending legal action by Cal Poly, San Luis Obispo against CalPolyOnline.com. I am awaiting their response to resolve the matter and if a solution is not provided by the Cal Poly university, the website will be transferred to a new domain address.

After talking with my colleagues and doing online research, I had a slim chance of keeping the former domain address, calpolyonline.com due to the cybersquatting law:

It was never my intention in the first place to ever misuse or profit from the trademark and did not realize "Cal Poly" was a registered trademark of the State of California. But what's done is done and everything needs to move on.

Everything remained the same and your account is still accessible under your usual username and password. Please update your bookmarks with the new address and let your Cal Poly friends know about it.

SLOPomona.com
All Cal Poly students know that SLO is the acronym for San Luis Obispo. California Polytechnic State University, San Luis Obispo is in SLO and Califorina State Polytechnic University, Pomona is in Pomona, hence the new domain: SLOPomona.com. Quite catchy, huh.

I'm very sure both SLO and Pomona are not registered trademark and both terms can be used in a domain name.

We represent California Polytechnic State University, San Luis Obispo, more commonly referred to as Cal Poly. It recently came to our attention that the domain name "calpolyonline.c om" has been registered by you and/or is being used in association with an IP address, nameserver, or network belonging to you, according to the WHOIS information included below.

Use of the Cal Poly name is protected by California law. According to California Education Code Section 89005.5, the "Cal Poly" name is the property of the State of California and may not be used to designate a business, activity or enterprise without permission of the Trustees of the California State University. We believe registering the "calpolyonline.c om" domain name and displaying the "calpolyonline.c om" website on your server or network is a violation of that law.

In addition, the "Cal Poly" logo is being displayed on the home page without our permission.

Therefore, by way of this email, we are requesting that you to immediately terminate and transfer to Cal Poly the domain name "calpolyonline.c om" and terminate access to the associated website being operated through your network or servers. If the site continues under a different domain name, the Cal Poly logo must be removed.

Your timely response to this request is appreciated. Please confirm receipt of this request and advise on what action you will be taking as a result. If no action is taken, this matter will be referred to the university legal counsel for further action.

Kevin, on advice of university legal counsel, your request for permission to continue using the domain name "calpolyonline.c om" is denied for the reasons stated in our original notice.

Since receiving your reply, we have been advised that "calpolyonline.c om" is redirecting to "slopomona.com", a notice about the transition has been posted on your site, and the Cal Poly logo has been removed.

Your prompt compliance with our previous notice is appreciated!

The current registration for "calpolyonline.c om" expires in December 2010. ITS Network Administration will be contacting you about transferring ownership of the domain name to Cal Poly before it expires.
